The New York State - Department of Health has a Prehospital DNR form
provided for in the State EMS Regulations (Part 800, State EMS Code). The
patient is identified by a simple Prehospital DNR form issued by the DOH or
a "medic alert' type bracelet which is available by prescription.
The State regulation re: DNR states that field personnel are required to
comply with the terms of a Prehospital DNR order on the basis of "good
faith". In other words, if the provider believes or disbelieves the
validity of an order in 'good faith', they shall not be subject to criminal
or civil liability as a result of their actions or omissions. The
regulation also provides for resuscitation of a patient with a valid order
in situations where someone on scene other than the responders objects to
the order, or if physical confrontation appears likely.
