Depends on the context. If, writing dialoge or responding to an email, someone
said, directly or implicitly, that the shops were open, I would say "the shops
are open?". But if, on the other hand, someone made some plan requiring the
shops to be open and I wasn't sure on that point, I would say "ARE the shops
open?".
